General Terms and Conditions

This English version is provided for convenience. In case of discrepancy, the Spanish version prevails.

1. Intellectual Property and Ownership

InOpinia's Property: All algorithms, source code, methodologies, AI model architectures and proprietary developments are the exclusive property of InOpinia S.L.
Client Data: The client retains full ownership at all times of the business data provided for the operation of the service.
Results (Outputs): The client owns the final results and analyses derived from the use of the service, unless expressly agreed otherwise in the service contract.

Probabilistic Results: The client acknowledges and accepts that Artificial Intelligence systems generate results based on statistical and probabilistic models.
Mandatory Supervision: It is the client's sole responsibility to supervise, validate and verify the results generated by the AI before applying them in critical processes, strategic decision-making or production environments.
Limitation of Liability: InOpinia S.L. shall not be liable for damages arising from an automated application of the results without due human supervision.

Mutual Commitment: Both parties undertake to maintain the strictest confidentiality regarding all technical and commercial information exchanged during the term of the business relationship.
Protection of Assets: This commitment specifically extends to trade secrets, business strategies and, especially, the training data shared for the customization of the models.

Use of Enterprise APIs: When using third-party language or generative models, InOpinia S.L. guarantees the exclusive use of enterprise-tier programming interfaces (APIs).
Protection against Public Training: It is contractually guaranteed that the data entered by the client will not be used by the providers of such models to train public versions of their AI, preserving the privacy and isolation of the client's information.
